Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Takt ("Takt", "we", "us") and govern your access to and use of Takt Sales and related websites, applications, and services (together, the "Service"). By accessing or using the Service, or by clicking "Continue", you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & Accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for all activity that occurs under your account and for keeping your sign-in credentials secure. Please notify us promptly of any unauthorized use.
2. Use on Behalf of an Organization
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and "you" then refers to that organization. Your organization’s administrators may manage your access, including suspending or removing your account.
3. The Service
The Service is a customer-relationship and sales-management platform. We may update, improve, or modify the Service from time to time, and we may add or change features. We will use reasonable efforts to give notice of material changes.
4. Acceptable Use
You agree not to misuse the Service. You will not: (a) break the law or infringe the rights of others; (b) attempt to gain unauthorized access to the Service or its systems; (c) interfere with or disrupt the Service; (d) reverse engineer or copy the Service except as permitted by law; or (e) use the Service to send spam or upload malicious code.
5. Customer Data
You retain all rights to the data that you and your users submit to the Service ("Customer Data"). You grant us a worldwide, limited license to host, process, and transmit Customer Data solely to provide and support the Service. You are responsible for the accuracy and legality of Customer Data and for having the rights and consents needed to provide it.
6. Privacy
Our Privacy Policy describes how we handle personal data. By using the Service, you acknowledge that we process data as described there and in these Terms.
7. Third-Party Services
The Service may integrate with third-party products (for example, email or calendar providers). Your use of those products is governed by their own terms, and we are not responsible for them. Enabling an integration authorizes us to exchange data with that provider as needed to operate it.
8. Fees & Subscriptions
Paid plans are billed in advance for the cycle described at purchase and are non-refundable except where required by law. We may change pricing on a going-forward basis with prior notice. Non-payment may result in suspension or termination of the Service.
9. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by Takt and its licensors and is protected by intellectual-property laws. These Terms grant you no rights in the Service other than the limited right to use it as permitted here.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends, and we may delete Customer Data after a reasonable period unless retention is required by law.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, Takt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms with a new date. Your continued use of the Service after the changes take effect means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-laws rules. The courts of Cairo, Egypt will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
